1. Acceptance of Terms

By accessing or using the posojilo.si platform, you agree to these Terms of Service. If you do not agree to the terms, you may not use the platform. posojilo.si reserves the right to modify these terms, and users will be notified via email or platform notification.

To use the platform, you must be of legal age (18 years or older), a resident of Slovenia or EU/EEA countries with a valid ID and tax number. You must successfully complete the identity verification process (KYC) and must not be on sanctions lists or subject to financial services restrictions.

4. Investor Services

The platform enables investors to browse vetted loans, review loan contracts, invest in selected loans, and receive monthly returns. Investors understand and accept that investments carry risk of loss, including the possibility of borrower default. Past returns do not guarantee future results.

5. Borrower Services

The platform enables borrowers to submit loan applications, which include a verification process (KYC, SISBON credit check, collateral assessment). Approved loans are listed on the marketplace with a prepared contract. Borrowers commit to timely repayment in accordance with the loan agreement terms.

6. Fees and Charges

posojilo.si charges a commission on successfully funded loans. The commission amount is transparently displayed with each loan. Late payment penalties are charged in accordance with the loan agreement terms. The platform reserves the right to change fees with prior notice to users.

7. Risk Disclosure

Investing in P2P loans carries risks, including default risk, liquidity risk, and market risk. Investors may lose part or all of their invested capital. posojilo.si does not guarantee investment returns. Users are advised to invest only funds they can afford to lose and to diversify investments across multiple loans.

8. Loan Agreements

The Loan Agreement is a legally binding document between the borrower and investors. The contract is prepared based on the approved application and contains all essential loan terms. The borrower signs the contract digitally before marketplace listing; the investor co-signs upon investment.

9. Identity Verification (KYC/AML)

All users must complete the Know Your Customer identity verification process in accordance with anti-money laundering legislation. posojilo.si reserves the right to refuse registration or freeze accounts in case of failed verification or suspected illegal activities.

10. Data Protection

11. Intellectual Property

All platform content, including text, graphics, logos, software, and databases, is the property of posojilo.si or its licensors. Unauthorised copying, distribution, or modification of content is prohibited.

12. Limitation of Liability

posojilo.si is an intermediary platform and is not a party to loan agreements. The platform is not liable for borrower defaults, investment losses, or indirect damages. posojilo.si strives for reliable platform operation but does not guarantee uninterrupted availability.

13. Dispute Resolution

Any disputes between users and the platform shall first be resolved through direct agreement. If agreement cannot be reached, the competent body for alternative dispute resolution under Slovenian law shall have jurisdiction. Users may also file a complaint with the Market Inspectorate of the Republic of Slovenia.

14. Governing Law

These Terms of Service shall be governed by the laws of the Republic of Slovenia. For disputes that cannot be resolved through alternative resolution, the court in Ljubljana shall have jurisdiction.

15. Amendments

posojilo.si reserves the right to amend these Terms of Service. Users will be notified of material changes at least 30 days in advance via email or platform notification. Continued use of the platform after changes take effect constitutes acceptance of the new terms.
